A better way to hand off an inherited legal file
How legal teams can preserve matter history, surface the current state, and help the next lawyer become useful sooner.
A file handoff is expensive when the story exists mainly in one person’s memory, inbox, and working notes. A stronger handoff preserves enough context for the next person to understand where the matter stands, why it arrived there, and what requires attention now.
Capture the current state first
The next lawyer does not need every document explained before they can begin. They need a reliable orientation: the current posture, active issues, immediate deadlines, recent communication, and decisions that shaped the present position.
That orientation should point back to the records behind it so the new lawyer can verify detail as questions arise.
Preserve decisions, not only documents
A folder can preserve the record while still losing the reasoning that made the record useful. A handoff should identify major decisions, alternatives considered, client instructions, and unresolved questions.
This does not require a second parallel file. The goal is to keep the explanation connected to the documents, communication, and timeline already associated with the matter.
- Current posture and desired outcome
- Upcoming commitments, requests, and deadlines
- Material decisions and the records supporting them
- Open questions that still require judgment
- Client expectations and recent communication
Let questions guide deeper review
Once the current picture is clear, the lawyer can move through targeted questions instead of reading a large file in an arbitrary order. Each answer should narrow the next review step and keep the source record close.
This approach does not remove the need to read important documents. It helps experienced people spend their attention where it matters first.
Make continuity a normal workflow
The best handoff starts before anyone knows a handoff will happen. When documents, decisions, communication, and matter history stay connected during daily work, continuity becomes a property of the file rather than a final administrative project.
